These terms of service ("Terms") govern your use of the game app ("App") provided to you by Piotr Klimko ("Publisher"). By downloading or using the App, you agree to these Terms.
Publisher grants you a non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only. You may not use the App for any other purpose without the prior written consent of Publisher.
The App is free to download and use, but it is supported by advertising. Publisher may display advertisements in the App from time to time, and you agree to view and interact with these advertisements as a condition of using the App. Publisher may collect and use data related to your use of the App and interactions with the advertisements in accordance with the Publisher's Privacy Policy.
The App, including all intellectual property rights in the App, belongs to Publisher or its licensors. You may not copy, modify, distribute, sell, or lease any part of the App, nor may you reverse engineer or attempt to extract the source code of the App, unless laws prohibit those restrictions or you have Publisher's written permission.
The App is provided "as is" and without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Publisher does not warrant that the App will be error-free or uninterrupted or that defects will be corrected.
Publisher shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of the App or these Terms, even if Publisher has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages, so the above limitations or exclusions may not apply to you.
You agree to indemnify, defend, and hold harmless Publisher, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the App or your breach of these Terms.
Publisher may terminate these Terms and your access to the App at any time without notice or liability to you. Upon termination, you must immediately cease all use of the App and destroy all copies of the App in your possession.
Publisher may modify these Terms at any time in its sole discretion. If we make changes to these Terms, we will notify you by updating the date at the top of these Terms. By continuing to use the App after the updated Terms become effective, you agree to be bound by the updated Terms.
These Terms and your use of the App are governed by and construed in accordance with the laws of the State of The Republic of Poland, without giving effect to any principles of conflicts of law. Any legal action or proceeding arising out of or in connection with these Terms or the App shall be brought exclusively in the federal or state courts located in pomorskie voivodeship, Poland, and you hereby consent to the jurisdiction and venue of such courts.
These Terms constitute the entire agreement between you and Publisher with respect to the App and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Publisher. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible, and the remaining provisions shall remain in full force and effect.
